How to find out which land plots are free and can be privatized for construction?

In accordance with the provisions of Article 122 of the Land Code, village, settlement, and city councils transfer land plots to the ownership or use of communal lands of the respective territorial communities for all needs.

In accordance with the fifth part of Article 24 of the Law "On Regulation of Urban Development" authorized bodies for urban planning and architecture and the central executive body implementing state policy in the field of land relations, ensure openness, accessibility and completeness of information on the availability of relevant administrative -territorial unit of state and communal lands, not provided for use, which can be used for construction, on the presence of restrictions and encumbrances on land plots, town-planning conditions and restrictions in town-planning and state land cadastres.

Until the relevant information is entered into the town-planning and state land cadastres, the executive body of the village, settlement, city council, Kyiv and Sevastopol city state administrations or the relevant local executive body are obliged to provide written information on the availability of land plots at the request of individuals and legal entities. can be used for construction.

In accordance with the provisions of Article 1 of the Law "On State Land Cadastre" State Land Cadastre - a single state geographic information system of land located within the state border of Ukraine, their purpose, restrictions on their use, as well as data on quantitative and qualitative characteristics of land, their assessment of the distribution of land between owners and users.


At the same time, according to the Regulation on the State Service of Ukraine for Geodesy, Cartography and Cadastre, approved by the Cabinet of Ministers of Ukraine dated 14.01.2015 № 15, the tasks of the State Geocadastre include, in particular, maintaining and administering the State Land Cadastre.

Today, the State Land Cadastre contains information on formed and registered land plots, information about which is entered on the basis of relevant land management documentation. However, information on unformed land plots in the State Land Cadastre is missing.

In this regard, information on the availability of vacant land plots of communal property is provided by the relevant councils.
